    Man shot by ICE agent in New York City’s Marble Hill, authorities say

    A man was hospitalized after being shot by a U.S. Immigration and Customs Enforcement agent in New York City’s Marble Hill neighborhood on Thursday, according to the Department of Homeland Security and New York City officials.

    The shooting occurred at about 4 p.m. local time near West 225th Street and Marble Hill Avenue.

    In a press conference Thursday night, NYPD Commissioner Jessica Tisch said ICE agents tried to arrest a man in a car with a 5-year-old boy in the backseat. One ICE agent fired seven rounds at the car, striking the 28-year-old Oscar Bergal in the neck, Tisch said.

    Officials said he was taken to a hospital with non-life-threatening injuries. The child was not injured and is in the care of a family member, Tisch said.

    The NYPD was not involved in the shooting, the department said. 

    DHS, ICE’s parent agency, said in a statement that officers were conducting a targeted enforcement operation to arrest a man from the Dominican Republic who they allege was living in the United States illegally.  

    DHS alleged that the man had associations to the Trinitarios gang. Tisch said he has two prior arrests. In 2023, he was arrested on a robbery charge and later pleaded guilty to fourth-degree larceny. He was also arrested in 2025 on a charge of criminal sale of a controlled substance, a case that remains pending.

    Tisch said NYPD cameras captured a vehicle backing into a parking spot in front of a fire hydrant. She says video shows one plainclothes federal law enforcement officer approaching the driver’s side window with his gun drawn and a second plainclothes officer approaching the vehicle by the driver’s side headlight. According to Tisch, the vehicle then moves forward out of view of the camera.

    An ICE officer discharged his weapon during the incident, injuring the man, DHS said.

    “ICE officers immediately rendered aid,” DHS said. “The individual is alive and at a local hospital. The FBI and HSI are on the scene. The incident remains under investigation. More information will be shared as it becomes available.”

    Tisch said NYPD officers who were in the area responded to the scene after hearing reports of shots fired.

    “When they arrived, they encountered several men in various forms of attire, including some in construction-style vests, face masks and at least one carrying a long gun,” she said.

    Tisch said Bergal was handcuffed and seated on the ground. According to Tisch, NYPD officers placed him into an NYPD vehicle, rendered aid and transported him to the hospital.

    Democratic Rep. Adriano Espaillat of New York told CBS News in an interview Thursday night that the 5-year-old child was the son of Bergal. Espaillat told CBS News that he met with the 5-year-old boy and his mother at the hospital, where Bergal received treatment.

    Espaillat disclosed Bergal was under guard by ICE agents outside his hospital room, and Espaillat was not allowed to see him.

    Late Thursday, Mayor Zohran Mamdani said ICE “put the man in an unmarked vehicle and whisked him away.”

    Mamdani said he spent two hours on the phone with President Trump and DHS Secretary Markwayne Mullin on Thursday night to negotiate for the release of Bergal, but those negotiations were unsuccessful.

    Federal agencies have taken over the investigation, Tisch said.

    The NYPD said five people were taken into custody during protests that broke out over the shooting.

    Democratic New York Rep. Alexandria Ocasio-Cortez called for a “full and independent investigation” of the incident and the release of all body camera video that captured it. She also said in a statement Thursday night that, “The Target Corporation must stop offering their Bronx properties as private staging sites for ICE, in compliance with requests from New York officials. Target opening up large, active retail parking lots for paramilitary activity is unacceptable and places the entire community at risk.”

    CBS News has reached out to Target for comment.

    There have been at least 30 shootings involving DHS officers during the second Trump administration, according to a CBS News analysis, some of which have turned deadly.

    Editor’s note 10/9/26 3:58 p.m.: Authorities initially said the last name of the man who was shot was Belgal. Authorities have since said his last name is Bergal. This story has been updated to reflect that change.
